On or about September 24, 2024, the City of Torrance will submit to the U.S. Department of Housing and Urban Development (HUD) the Consolidated Annual Performance and Evaluation Report (CAPER) for the Fiscal Year (FY) 2023-24, as required by Section 104 (d) of the Housing and Community Development Act of 1974, as amended.

The report contains activities undertaken and/or completed using FY 2023-24 HOME Investment Partnerships Program funds.

The CAPER (FY 2023-24) will be available for public examination and comment for a period of fifteen (15) days beginning September 9, 2024 and ending September 23, 2024. NOTICE IS HEREBY GIVEN that the City Council appoints the day of July 2, 2024 at the hour of 6:30 p.m., for a public hearing regarding the SUBSTANTIAL AMENDMENT TO THE FIVE-YEAR CONSOLIDATED PLAN COVERING FISCAL YEAR (“FY”) 2023-27 AND AN ANNUAL ACTION PLAN COVERING FY 2024-25: Conduct Public Hearing on the Substantial Amendment to the Five-Year Consolidated Plan Covering Fiscal Year (FY) 2023-27 and Annual Action Plan Covering FY 2024-25, Approve and Authorize Submission of Substantial Amendment to the FY 2023-27 Consolidated Plan and FY 2024-25 Action Plan, and Authorize City Manager to Execute Documents.

A Consolidated Plan is required by the U.S. Department of Housing and Urban Development (HUD) as a condition of receiving federal funding. The City is eligible to receive HUD funding from the HOME Investment Partnerships (HOME) program and Community Development Block Grant (CDBG) program.

In summary, the Consolidated Plan serves four separate, but integrated, functions. The Consolidated Plan is:  a planning document for the jurisdiction, which builds on a participatory process at the lowest levels; an application for federal funds under HUD’s formula grant programs (CDBG, HOME, Emergency Shelter Grants (ESG), and Housing Opportunities for Persons with AIDS (HOPWA)); a strategy to be followed in carrying out HUD programs; and, lastly, and action plan that provides a basis for assessing performance. The Substantial Amendment to the FY 2023-2027 Consolidated Plan will add the administration of the CDBG program and remove HOME-ARP funding.

The Substantial Amendment to the Five-Year Consolidated Plan will also include the addition of an Annual Action Plan for Fiscal Year July 1, 2024 through June 30, 2025.  The Annual Action Plan contains a list of activities the City will undertake to address priority housing and community development needs and local objectives with anticipated HOME and CDBG funding received during the next program year.  The Annual Action Plan is submitted annually and prepared according to HUD regulations.  A copy of HUD's final rule (issued January 5, 1995, Federal Register) is available upon request.

HOME funds can be used to:  provide incentives to develop and support affordable rental housing and homeownership affordability through the acquisition (including assistance to homebuyers), new construction, reconstruction, or rehabilitation of non-luxury housing with suitable amenities, including real property acquisition, site improvements, conversion, demolition, and other expenses, including financing costs, relocation expenses of any displaced persons, families, businesses, or organizations; provide tenant-based rental assistance, including security deposits; provide payment of reasonable administrative and planning costs; and, provide for the payment of operating expenses of community housing development organizations. The City has been notified by HUD that Torrance will be receiving $440,017 in HOME funds for FY 2024-25. The City anticipates approximately $505,500 in HOME carryover funds from FY 2023-24. Of the HOME funds received, no more than 10% can be used for administrative and program delivery activities. 15% is set aside for Community Housing Development Organizations, as constituted under the regulations.  The balance of funds can only be used for housing activities.

CDBG funded activities must meet one of the following objectives: provide benefits to low or moderate-income persons, eliminate slum or blighted conditions, or address an urgent community development need that poses a serious and immediate threat to the health or welfare of the community. CDBG funds may be used for the following activities: Acquisition of real property; Relocation and demolition; Rehabilitation of residential and non-residential structures; Construction of public facilities and improvements, such as water and sewer facilities, streets, neighborhood centers, and the conversion of school buildings for eligible purposes; Public services, within certain limits; Activities relating to energy conservation and renewable energy resources; Provision of assistance to profit-motivated businesses to carry out economic development and job creation/retention activities. The City has been notified by HUD that Torrance will be receiving $1,002,313 in CDBG funds for FY 2024-25. Of the CDBG funds received, no more than 20% can be used for administrative and program delivery activities and 15% for public service activities.

In addition, pursuant to Section 508 of the Act, the City of Torrance has developed and is following a detailed Citizen Participation Plan.  A copy of the plan is available for public inspection.

In addition to Standard Form 424, the Annual Action Plan includes the appropriate Certifications.

CDBG funds may be used for the following activities: Acquisition of real property; Relocation and demolition; Rehabilitation of residential and non-residential structures; Construction of public facilities and improvements, such as water and sewer facilities, streets, neighborhood centers, and the conversion of school buildings for eligible purposes; Public services, within certain limits; Activities relating to energy conservation and renewable energy resources; Provision of assistance to profit-motivated businesses to carry out economic development and job creation/retention activities. The City anticipates receiving approximately $989,190 in CDBG funds for FY 2024-25. 

In preparing the substantial amendment to the Five-Year Consolidated Plan and FY 2024-25 Annual Action Plan, the statute requires that the jurisdiction hold at least one (1) public hearing during the development of the Consolidated Plan/Action Plan to obtain the views of citizens on housing and community development needs. The October 24, 2023  public hearing serves this purpose. Public hearings are held to provide the community with an opportunity to comment on, and respond to, recommendations and issues. The HOME and CDBG funding allocations listed in this notice are estimates based on prior year allocations; HUD has not yet announced FY 2024-25 awards. 

Citizens’ wishing to comment on the City’s Substantial Amendment to the  Five-Year Consolidated Plan and/or FY 2024-25 Annual Action Plan after the public hearing date of October 24, 2023, may do so in writing.  Written comments must be addressed to:

NOTICE OF NOTICE OF MEETING

NOTICE IS HEREBY GIVEN that the City Council appoints the day of June 20, 2023 at the hour of 6:30 p.m., for a public hearing regarding the FIVE-YEAR CONSOLIDATED PLAN COVERING FISCAL YEAR (“FY”) 2023-27 AND AN ANNUAL ACTION PLAN COVERING FY 2023-24: Conduct Public Hearing on the Five-Year Consolidated Plan Covering Fiscal Year (“FY”) 2023-27 and Annual Action Plan Covering FY 2023-24, Approve and Authorize Submission of FY 2023-27 Consolidated Plan and FY 2023-24 Action Plan, and Authorize City Manager to execute documents.

A Consolidated Plan is required by the U.S. Department of Housing and Urban Development (HUD) as a condition of receiving federal funding. The City is eligible to receive HUD funding from the HOME Investment Partnerships (HOME) program.

In summary, the Consolidated Plan serves four separate, but integrated, functions. The Consolidated Plan is:  a planning document for the jurisdiction, which builds on a participatory process at the lowest levels; an application for federal funds under HUD’s formula grant programs (CDBG, HOME, Emergency Shelter Grants (ESG), and Housing Opportunities for Persons with AIDS (HOPWA)); a strategy to be followed in carrying out HUD programs; and, lastly, and action plan that provides a basis for assessing performance.  The City does not currently have a Consolidated Plan.

The Five-Year Consolidated Plan includes an Annual Action Plan for Fiscal Year July 1, 2023 through June 30, 2024. The Annual Action Plan contains a list of activities the City will undertake to address priority housing and community development needs and local objectives with anticipated HOME funding received during the next program year.  The Annual Action Plan is submitted annually and prepared according to HUD regulations.  A copy of HUD's final rule (issued January 5, 1995, Federal Register) is available upon request.

HOME funds can be used to:  provide incentives to develop and support affordable rental housing and homeownership affordability through the acquisition (including assistance to homebuyers), new construction, reconstruction, or rehabilitation of non-luxury housing with suitable amenities, including real property acquisition, site improvements, conversion, demolition, and other expenses, including financing costs, relocation expenses of any displaced persons, families, businesses, or organizations; provide tenant-based rental assistance, including security deposits; provide payment of reasonable administrative and planning costs; and, provide for the payment of operating expenses of community housing development organizations.

The City has been notified by HUD that Torrance will be receiving $510,196 in HOME funds for FY 2023-24.  Of the HOME funds received, no more than 10% can be used for administrative and program delivery activities. 15% is set aside for Community Housing Development Organizations, as constituted under the regulations.  The balance of funds can only be used for housing activities.  Additionally, the City received $1,710,939 in FY 2021 HOME-ARP funds for supportive services for people experiencing homelessness in 2022.

2.         Include administrative and planning costs not accepting displacement.

However, understanding that certain projects undertaken with HOME funds could result in displacement, the City of Torrance has developed a plan to assist persons actually displaced by HOME activities.  This plan requires that the City provide replacement housing and relocation assistance and benefits in conformance with Section 104(d) of the Housing and Community Development Act of 1974, as amended, and the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, as amended.  A copy of the plan is available for public inspection.

In addition, pursuant to Section 508 of the Act, the City of Torrance has developed and is following a detailed Citizen Participation Plan.  A copy of the plan is available for public inspection.

In addition to Standard Form 424, the Annual Action Plan includes the appropriate Certifications.

NOTICE IS HEREBY GIVEN that the City of Torrance’s DRAFT FIVE-YEAR CONSOLIDATED PLAN COVERING FISCAL YEAR (“FY”) 2023-27 AND ANNUAL ACTION PLAN COVERING FY 2023-24 will be available for public review and comment beginning Thursday, May 18, 2023.
